Article 95 Requirements in Europe: What They Mean for Glyclean® D Customers

For companies placing biocidal products on the European market, supplier compliance is an important part of product selection. Under the EU Biocidal Products Regulation, companies cannot place biocidal products on the market in the EU unless the active substance supplier or product supplier is listed on the approved supplier list (Article 95).

For customers using glycolic acid in supported biocidal applications, Glyclean® D Glycolic Acid products from PureTech Scientific LLC are positioned to support compliance requirements for the relevant Product Types in Europe.

Why Article 95 Matters

Article 95 helps ensure that active substance suppliers for biocidal products are recognized within the EU BPR framework. This matters across the supply chain because customers need confidence that the materials they source can remain in compliant biocidal products.

Since 1 September 2015, the attached PureTech Scientific letter states that biocidal products cannot be made available on the EU market unless the active substance supplier or product supplier is included in the Article 95 approved supplier list.

Glyclean® D and EU BPR Support

PureTech Scientific LLC’s Glyclean® D Glycolic Acid is identified as glycolic acid, CAS 79-14-1 and EC 201-180-5. The letter states that Glyclean® D is in the process of obtaining approval as a biocidal active substance under Regulation (EU) No 528/2012 (the EU Biocidal Products Regulation).

The supported biocidal Product Types are:

What Customers Need to Know

The letter states that all Glyclean® D products sold in the European Union and European Free Trade Area by PureTech Scientific LLC for PT 2, PT 3 and PT 4 meet the requirements described in Article 95 of the BPR. It also notes that biocidal products containing glycolic acid from PureTech Scientific LLC as an active substance can continue to be sold along the supply chain in compliance with the BPR, provided they meet all other requirements.

This is important for formulators, distributors, and product owners because Article 95 status supports continued supply-chain access while the active substance review process continues.

Continued Use During the Review Process

PureTech Scientific states that glycolic acid remains allowed for use in the notified biocidal Product Types while the evaluation process continues. The letter also notes PureTech Scientific LLC’s commitment to the long-term use of glycolic acid in biocidal products in Europe.

For customers, this means Glyclean® D remains relevant for supported PT 2, PT 3 and PT 4 biocidal applications under the current BPR review framework described in the letter.
